LEGALIZATION DEFINITIONS FOR: STATE – FEDERAL – EMBASSY / CONSULATES
At the state level the word “apostille” indicates one of two things:
1. The state’s legalization of a properly prepared document to be presented in a foreign country
belonging to the Hague Convention of October 1961.
2. The state’s legalization of any properly prepared document to be present in any foreign country,
whether or not it belongs to the Hague Convention of October 1961.
Several states issue a “Legalization” under the name “Apostille” only for documents destined to be
present in Hague Convention countries and a “Certification” or “authentication” for Non-Hague
Convention countries.
The U.S. Department of State Apostille is a legalization issued by the U.S. Dept. Of State for Federal
documents signed by a federal official with the proper elements that are destined for Hague Convention
countries. State issued documents cannot receive this type of legalization.
The U.S. Department of State Authentication certifies the signature of the Secretary of State in which
the doc was executed, or the signatures of federal agency docs and courts docs executed by the District
of Colombia which contain the proper elements. This type of legalization is usually required for docs
destined for Non-Hague Convention countries.
The Clerk of the Court Apostille certified documents of a Federal court of the U.S. as authentic for
presentation in foreign countries. It is issued by the respective Federal Clerk of the Court. This type of
Apostille is applicable only to Federal Court Documents.
Embassy/Consulate Legalizations are legalizations (authentications) that are usually required by Non-
Hague Convention Countries. In most cases the respective Embassy or Consulate attaches their own
legalization to the documents after the document has been legalized by the U.S. Department of State.
(However, there are Non-Hague Convention countries that require only the state legalization as a
mandate for issuing their respective embassy/consular legalization.)

We are unable to obtain Vital record documents (birth, death, marriage, etc….). You can contact the County Clerk and request a new certified copy. But, we do recommend that you mail in the original or certified copies that you currently have in your processing.
An Apostille does NOT have an expiration date. The country requesting your documents may set a time limit on how old the document and Apostille can be. For example, and FBI background check must be issued within the past three months and with an FBI Apostille in order to be accepted. Before sending in your documents, be sure to check with the person requesting it to make sure they will accept your documents once the Apostille is attached.
It doesn’t but most all countries will request your FBI background check be issued within the past three months. If it has been more than three months since your past FBI background check, we recommend that you contact an FBI Channeler to help expedite the process in obtaining a new copy.
A Birth Certificate can NEVER be notarized. There are no exceptions to this rule. In order to Apostille a Birth Certificate you will need to send it to the Secretary of State in which it originated.
No, a document is always Apostilled from the State in which is originated. So, if Jane lives in Boston, and has lived in Boston for 50 years, but she went to collect in Tennessee and needs her diploma Apostilled, it will need to be Apostilled by the Secretary of State of Tennessee.

Apostillization of documents can be a difficult process. In most cases, you will need to obtain an original, certified copy of the document you want Apostilled. Once obtain, it will be submitted to the issuing office of authentications, such as the Secretary of State for Apostille.
